Injured people are having their first conversations about their case with AI, and what AI tells them is built mostly from firm marketing.
Lydia said something on a call this week that put a name on what we’ve been watching in the AI for PI Index™ data: demand suppression.
The idea is simple. After an accident, people have questions, what the case might be worth, whether the adjuster’s offer is fair, who they can trust with their situation. More and more of those first conversations happen with AI. By the time somebody calls a firm, part of the decision has already happened in those conversations, and when the decision goes against a firm, or against hiring a lawyer at all, the firm never sees it. The phone just rings less.
Personal injury already converts about 7% of leads into consultations, the lowest rate in legal (per MyCase’s 2024 Benchmark Report). That number comes from before injured people started these conversations with AI. We think it goes down from here if nothing changes. We used to think of demand as constrained, but its actually being suppressed now due to AI.
The Index lets us look inside those conversations. Every cycle we collect the answers AI gives when people ask about personal injury lawyers, 21,624 of them in the latest update as of August 3, 2026, plus every source those answers cite.
The answers are built from marketing. 71.7% of everything AI cited about injury firms was firm marketing, court records never appeared, and news coverage was under 0.1%.
And the marketing mostly says the same things. “Free consultation” showed up in about three of four answers, “no fee unless you win” in about half. None of that separates one firm from another, and it has nothing to do with what the injured person is looking for: the best-fit lawyer for them and for their case. What the answers offer instead is superlatives. AI called a firm “the best” in 55% of the answers where nobody asked for the best, and it repeated firms’ recovery totals as fact, four of five of those sentences with no source at all. One firm’s total appeared at seven different amounts in one week, anywhere from $9 billion to $35 billion.
Fit takes questions, and we’ve watched what happens when AI gets the chance to ask them. The AI carried the whole conversation and recommended next steps without ever asking what fell or who ran the site, and in a construction case those two answers largely decide who the case is against and what it’s worth.
So the first conversation runs on marketing, skips the questions that determine fit, and ends with confident recommendations. All of it happens before any attorney knows the person exists.
What happens in that window, from injury to intake, is what we call The Pre-Intake Problem™ – and it has been largely unserved until now.
